Structural engineer supervision in Kenya: when the slab failed but the drawings were right

Cut the structural fee. Dropped supervision. Trusted the contractor. KES 90M in the ground — then the slab cracked.

The developer's decision

The full-service structural fee looked too high. Design-only would still produce drawings for county approval — that was enough, the developer decided.

So the structural fee was cut roughly in half. Site supervision came out of the scope letter. The developer kept the drawings but dismissed the EBK engineer from site visits. Cube tests before every pour, reinforcement checks, hold points that slowed the contractor — all treated as optional overhead.

The contractor filled the gap with a familiar offer: his own internal engineer would inspect the works, and the firm would carry the liability. Cube tests were 'slowing the programme'. The developer agreed. Supervision was making the project feel expensive; the contractor was promising speed and certainty.

Progress photos went to the bank. Interim certificates were signed on percentage complete, not on cleared structural holds. Approved drawings sat in the project file. At that point, the developer believed the hard part — design and approval — was done.

Then the crisis unfolded

Halfway through the frame, roughly KES 90 million was already in the ground — foundations, columns, slabs, finishes on lower levels. Then the slab cracked.

That was not the end of it. Partial formwork collapsed on an upper floor. A worker was injured. Work stopped entirely.

NCA flagged the site. The county issued stop-work orders. Demolition was on the table. Buyers who had reserved units pulled out. Tenants and investors who were already circling began to walk — even where the visible damage looked like 'just a crack', presales and lettings collapsed because nobody trusts a building under statutory investigation.

Lawsuits followed — from the injured worker, from purchasers, from lenders asking why certificates were issued against progress photos instead of engineer clearance. Statutory bodies were no longer asking polite questions.

The structural drawings on file still showed Grade 30 concrete and Y16 bars at the specified spacing. On paper, the design was correct. Nobody with EBK registration had cleared a single pour. The contractor denies substitution. The engineer the developer dismissed is not in the site file to prove what was built. The developer — as client — is exposed too.

What actually happened on site

The crack did not come from a calculation error in the office. It came from what was built while nobody independent was watching.

The developer trusted the contractor. On site, steel was swapped — Y16 in the drawings, Y12 in places nobody photographed. Bar spacing drifted where cover was reduced to speed fixing. Concrete was specified as Grade 30; pours went ahead without cube tests, and samples later suggested material closer to Grade 10 — or no reliable record at all.

The contractor had also advised that one more floor was achievable without revisiting the structural engineer. Load paths designed for four storeys do not safely carry five or six because upper-floor rent looks attractive. Formwork was reused beyond tolerance. Pours proceeded before the slab below had cured.

There were no written non-conformance reports — because nobody with a client appointment was there to write them. County and NCA did not find a design failure on paper. They found a site that had outrun every independent check.

How it could have been avoided

Small decisions at appointment stage set up the crisis. Each of the following would have interrupted the project before KES 90 million was buried in defective concrete:

→ Cube-test pass before every pour — Grade 10 never enters a slab specified as Grade 30.

→ Reinforcement inspected and photographed at fixing stage — bar substitution caught before cover is closed.

→ No pour without written EBK engineer clearance — formwork, curing, and loading risks flagged before collapse.

→ QS interim payment gated on engineer sign-off — the contractor cannot cash-flow past non-compliance.

With full-service appointment, professional liability for structural conformity sits with your appointed EBK engineer — not with the contractor's internal inspector. The developer remains liable as client, but with a site file: inspection reports, photographs, stop-work instructions, and proof of what was approved before each pour.

That file is what keeps buyers and lenders at the table when something goes wrong — and what stops small defects becoming total losses. Occupiers and investors do not stay for promises. They stay for certification backed by records.

Why a small fee cut leads to total loss

The maths is not close.

On a KES 90 million construction project (EBK band KES 25M–100M), full-service structural engineering — design plus supervision — is typically 2.5% of construction cost: about KES 2.25 million. Design-only is about 1.5%: roughly KES 1.35 million. Cutting supervision saved about KES 900,000.

Within a full-service appointment, roughly 20% of the fee is allocated to construction inspection — about KES 450,000 on KES 2.25 million. That buys the site visits, cube-test discipline, and written hold reports that catch substitution before it is buried.

Compare KES 450,000–900,000 of avoided inspection to KES 90 million already sunk when stop-work hits — partial demolition, propping, redesign, legal defence, buyer walkaways, and the months or years before any revenue. Partial rebuild after a serious structural defect commonly runs 10–30% of project value.

Lean design is not the same as deleting supervision. A competent structural engineer optimises member sizes and load paths — saving material while staying inside code. Skipping site inspection is not lean. It is building blind with approved PDFs in a folder.

Documented Kenya cases — the same pattern in real files

NCA investigations into building collapses repeatedly cite poor workmanship, substandard materials, inadequate supervision, and construction continuing despite enforcement notices — not only errors on the original calculation sheet.

The Huruma collapses in Nairobi (January 2015 and April 2016): court and investigation records referenced poor concrete mix, inadequate reinforcement, lack of supervision, and occupation despite buildings being marked unfit. In November 2022, a seven-storey collapse in Kasarani occurred after non-compliance notices were ignored — including a site closure order the same day. In December 2024, a seven-storey project in Rongo, Migori County collapsed after NCA had raised structural concerns and suspended works pending a structural integrity report.

In each public record, the story is the same: work proceeds without independent professional control; materials and loading diverge from what was approved; enforcement arrives after people or capital are already at risk.

For Muslim developers using Istisna or equity milestones, paying contractors on programme without engineer and QS certification at each milestone recreates the same blind spot — Shariah structure does not replace EBK site records.

Checklist before you break ground

→ Appoint an EBK-registered structural engineer on full-service scope (design + inspection). Design-only is a documented risk acceptance — not a default.

→ List inspection hold points in the contract: foundation, columns, slabs, retaining works, any structural variation. No pour without cleared inspection where the schedule demands it.

→ Require written site inspection reports within 48 hours of each visit. Non-conformance triggers stop-work until cleared or re-engineered.

→ Reject the contractor's internal engineer as a substitute for your appointed EBK engineer unless a peer-review regime is explicitly defined in writing.

→ Require cube tests and steel records before pours — not after county or NCA intervention.

→ Never add storeys without revised structural drawings and county approval.
